Chapter 13 vs. Chapter 7 Bankruptcy: Which One Should You File?
Chapter 7, often called "liquidation bankruptcy," involves selling some of your assets to repay your debt. On the other hand, Chapter 13 is known as "reorganization bankruptcy." It lets you create a plan to repay your debts over time without giving up most of your important belongings. Chapter 13 might be a better option for some because it offers a way to keep assets and make debts more manageable.
Consider Chapter 13 if:
- You have a steady income and can make regular payments.
- You want to prevent foreclosure on your home.
- You have nonexempt property you wish to keep.
- You owe debts that can be restructured to provide more manageable repayments.
- Your debts are primarily consumer debts.
Bankruptcy laws exist to help, not to shame anyone. They're designed to support you when times are tough and offer a fresh start. It's important to remember that these laws are tools to help people rebuild their financial future. Hands Law can help facilitate this process for you.

The Chapter 13 Bankruptcy Process
To proceed with Chapter 13, it's important to meet certain requirements and have someone knowledgeable to guide you through the steps. Typically, it takes three to five years to complete the process. At Hands Law, we aim to make this process as easy to understand and handle as possible.
We can assist with the Chapter 13 process by:
- Assessing your financial situation - We'll help you review your income, expenses, and debts to understand your financial picture.
- Creating a repayment plan - Together, we'll work out a plan that shows how you'll pay back your debts over time. This will need approval by the court.
- Submitting the plan to the court - Once the plan is ready, it gets filed with the court. The court reviews it alongside your financial details.
- Creditor meeting - This meeting, usually called a "341 meeting," allows creditors to review and discuss the plan with you, though typically they do not attend.
- Plan confirmation - If the court agrees with the plan, you'll start making repayments based on its terms. The goal is to keep up with all payment duties as outlined.
After completing your repayment plan, the remaining eligible debts may be discharged, which means you're no longer responsible for paying them. This offers a chance to move forward with a cleaner financial slate. If Chapter 13 sounds like a potential solution for you, contact Hands Law to explore your options.
